Introduction

Welcome to joincake.com (the "Site") owned and operated by My Exit Strategy, Inc. (the "Company," "us" or "we"). We respect that the information you store in the User Account (as defined in our Terms of Use) is highly personal and may be sensitive in nature. You are always in complete control of who can see your information. We pledge the following:

  • Anything you store in your User Account (“Private Submitted Items”) is private by default. Sharing of Private Submitted Items will always be opt-in. In other words, your Private Submitted Items will always be private unless you specifically choose to share them with someone. We will never make this choice for you.
  • Clarity and transparency are the guiding principles for how we design our privacy controls. You will always be able to see who has access to your Private Submitted Items and who does not. We make it as easy and simple as possible to update your privacy settings and manage who has keys to your User Account.

This Privacy Policy does not apply to any Public Submitted Items (as defined in our Terms of Use).  Please be careful before including any information in a public forum, discussion or other space within the Site or Services.

We have adopted this Privacy Policy to further the relationship between us and our users. This statement of our Privacy Policy makes disclosures concerning our collection of information, including personal information, when you use the Site or any other features, content, or applications offered from time to time in connection with the Site, excluding third party features, content, or applications not provided by us but accessible from the Site (the “Services”), and how we use and disclose it to others. By using the Site or the Services you accept the practices described in this Privacy Policy.

Information We Collect

We collect personal and non-personal information when you provide it to us in the course of using the Site or the Services. The personal information that we may collect includes your name, gender, location, and email address. The non-personal information that we may collect includes your browser type, the URL of the previous website you visited, your ISP, operating system, and your Internet protocol (IP) Address. The non-personal information is not used by us to personally identify you and is not readily usable for that purpose.

When you register to use the Site or our Service or otherwise make a purchase from us using our Site or Services we will collect your name, gender, location, email address, mailing address (if necessary) and other information that we request during the registration and/or purchase process. The information you provide to us may reveal or allow others to identify aspects of your life that are not expressly stated (for example, your name may reveal your gender). By providing information to us when you create your account, you are expressly and voluntarily accepting the Terms and freely accepting and agreeing to our processing of your information in ways set out by this Privacy Policy.

In addition, if you communicate with us regarding the Site or any of our Services or products, we will collect any information that you provide to us during the course of our communication.

We may use analytic and reporting technologies to record non-personal information such as Internet domain and host names, Internet protocol (IP) addresses, browser software, operating system types, click patterns, and the dates and times that the Site and our Services are accessed by you. We may contract with a third party to help us manage, monitor and optimize our Site and the Services and measure the effectiveness of our advertising, communications and use of the Site and/or Services. Our Use of Information for Internal Purposes

We use your personal information primarily for our own internal purposes, such as providing, maintaining, evaluating, and improving the Site and Services as well as any products we sell, and to provide customer support.

We use the non-personal information we collect to track the use of the Site and Services and to assist us in maintaining, evaluating, and improving the Site and Services and products we sell.

Our Disclosure of Personal Information to Third Parties

We will disclose your personal information to protect or enforce our legal rights and policies, to protect or enforce the legal rights of a third party, or as we in good faith believe we are required to do so by law (such as to comply with a subpoena or court order, for example).

We intend to take commercially reasonable steps to enforce such non-disclosure and confidentiality agreements if and when we become aware of any violations.

We will disclose your personal information if we sell some or all of our assets to another company in connection with a business merger or acquisition connection with a business merger or acquisition. Any third party to which we transfer or sell our assets will have the right to continue to use your information in the manner set out in this Privacy Policy.

California Civil Code Section 1798.83, known as the “Shine The Light” law, permits our customers who are California residents to request and obtain from us a list of what personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge. Under Section 1798.83, we currently do not share any personal information with third parties for their direct marketing purposes. 

Our Disclosure of Non-Personal Information to Third Parties

We may disclose non-personal Information, in de-identified, aggregate form, to potential strategic partners, advertisers, investors, customers, and others. You may not opt-out of the sharing of this information.

Our Use of Cookies and Web Beacons

A cookie is a small file placed on the hard drive of your computer. Most websites use cookies. We will use cookies to track your use of the Site and the Services and products we sell, provide you with a more personalized user experience, and to facilitate your logging in to the Site.

A web beacon is an often-transparent graphic image, usually no larger than a 1x1 pixel that is placed on a web page or in an e-mail that is used to monitor the behavior of the user visiting the Site or receiving the e-mail.

Cookies and web beacons used by us will not be linked to your personal information.


Do Not Track Option

Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. The Site and Services do not support Do Not Track requests at this time, which means that we collect information about your online activity both while you are using the Site and Services and after you leave the Site and Services.

How We Protect Your Personal Information

We consider protecting the security of your personal information as very important. When you enter personal information on our registration or order forms, we encrypt that information using secure socket layer technology (sometimes referred to as "SSL").

We follow generally accepted industry standards to protect personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we do not guarantee absolute security. Reviewing and Changing Your Personal Information

You may obtain a copy of and request that we correct errors in your personal information by emailing us at support@joincake.com. If you do desire to obtain a copy of your personal information, you will be required to provide proof of your identity. If your personal information changes or if you no longer want to use the Site or the Services, you may correct, update or deactivate your personal information and your account through the account management screen. If you wish to deactivate or terminate your access to the Site or Services you may also contact us at support@joincake.com.

Application of Privacy Policy If You Access Third Party Websites

When you pay us a fee for access and use of the Site or the Services or purchase a product from us a third party (and not us) will accept payment for such subscription or purchase.  In addition, you will be able to access third party websites and services and purchase products from third parties directly from the Site or through the Services. This Privacy Policy does not apply when you access third party websites or services or purchase products, whether from us or a third party. We cannot control how third parties may use personal information you disclose to them, so you should carefully review the privacy policy of any third party website or service you visit before using it, purchasing any Service, service or product or disclosing your personal information to such third party.

Children's Privacy

The Site and the Services and products we sell are intended for people planning end of life related matters. Therefore, it is unlikely that children under the age of 18 will use the Site or the Services or products we sell. Accordingly, we will not knowingly collect or use any personal information from any person under the age of 18. In addition, we will delete any information in our database that we know originates from a person under the age of 18.

Opting-Out From Receiving Communications From joincake.com

You may opt-out from having your personal information used for certain purposes. For example, if you use the Site or the Services or purchase a product from us but do not wish to receive any additional marketing material from us, you may indicate your preference on our order form.

If you no longer wish to receive any promotional or other communications from us, you may opt-out by following the instructions included in each email communication or by emailing us at support@joincake.com. Changes in Privacy Policy

This Privacy Policy is subject to change from time to time. We will notify you by email or on our Site or through an email whenever there is a change in our Privacy Policy. The date of this version of our Privacy Policy is September 4, 2018.
